EU Intellectual Property Office (EUIPO) launches the EU out-of-commerce works portal

Out-of-commerce works are copyrighted works that never were or no longer are available through customary channels of commerce. Launched today, the new platform ‘Out-Of-Commerce Works Portal’ allows cultural heritage institutions and other organisations to share information about out-of-commerce works to ensure that they are accessible to the public.

The portal is launched by the European Union Intellectual Property Office (EUIPO) to make available the millions of out-of-commerce works that European libraries, archives, museums and other cultural heritage institutions currently contain. The works hold great value for research, education and/ or entertainment. The portal will also make it easier for the rights-holders of the works to exercise their rights.

The platform is a result of the  Directive on copyright and related rights in the digital single market (EU) 2019/790) , which introduces a legal framework to support cultural heritage institutions in the digitisation and cross-border dissemination of out-of-commerce works. The directive was adopted to assist cultural heritage institutions fulfil their mission to benefit European culture.
